The Supreme Court said in its decision that the 14-year-old rape victim will have an abortion. The court said that this is a case of rape. Also, the victim is 14 years old.
The Supreme Court gave a major decision on Monday. While hearing the case of abortion of rape victim, the Supreme Court said that the 14 year old rape victim will undergo abortion. The court allowed the 14-year-old rape victim to abort her pregnancy in the 30th week. The top court said that this is a case of rape. Also, the victim is 14 years old. In this exceptional case, abortion is permitted.
medical examination order
Earlier on April 19, the Supreme Court had ordered medical examination of the 14-year-old alleged rape victim. The victim had filed a petition in the Supreme Court demanding termination of her 28-week pregnancy. A bench of Chief Justice DY Chandrachud and Justice JB Pardiwala assembled for urgent hearing of the case at around 4:30 pm on April 19 after taking note of an e-mail sent by the rape victim seeking immediate judicial intervention.
Additional Solicitor General Aishwarya Bhati represented the government in the case. The court had sought a report from Mumbai’s Sion Hospital on the possible physical and psychological condition of the girl if she underwent a medical abortion or was advised not to do so.
28 weeks pregnant
The apex court heard a petition filed by the girl’s mother, challenging the Bombay High Court order which had refused to allow termination of the pregnancy. The lawyer appearing in the court on behalf of the petitioner had said that the minor is 28 weeks pregnant and is currently in Mumbai.
What MTP Act?
Let us tell you that under the Medical Termination of Pregnancy (MTP) Act, the maximum limit for termination of pregnancy for married women as well as special categories of women is 24 weeks. These include rape victims and other vulnerable women such as the disabled and minors.
